Dear Mr. Schultheis:

Thank you for your recent correspondence regarding the $5 late fee on the account above. The documentation your submitted is sufficient to waive the late fee on the account.

In your letter, you expressed concern regarding our request to see a copy of your check and register. The Recycle Plus program and its billing policies are set in accordance with San Jose City Ordinance. Therfore, we are unable to extend a courtesy to one resident that is not extended to another. This is the reason your financial information was requested. By verifying that your check was written well in advance of the due date, we could see that there was a delay in the posting of your check. This verification, gave us the ability to waive the late fee and evaluate the efficiency of our remittance processing procedures. I apologize for the delay and any inconvenience this caused.

I have enclosed the financial documents that were submitted to our office. You will see the $5 adjustment on your next statement. If you have any further questions, please contact me at (408) 277-xxxx. Thank you for your patience in this matter.
